In addition to her litigation practice, she counsels clients on all areas of federal, state and local employment law, including executive terminations; severance agreements; workforce reductions; and compliance with federal and state obligations such as the WARN Act and the Older Workers Benefit Protection Act.
She also provides advice regarding the proper validation of employment selection procedures to ensure compliance with Title VII and other applicable employment laws. Esther has specific expertise in testing validation and she routinely reviews validation and adverse impact studies to provide clients with strategic advice regarding the defensibility of selection devices, including algorithmic decision-making tools used to assess applicants and employees.
She previously served as the principal deputy chief of the Employment Litigation Section within the Civil Rights Division of the DOJ.

Patricia regularly advises general counsel, executive management, CEOs, boards of directors, retirement and health plan committees and key leadership of Fortune 500 companies on complex questions and issues regarding the operation of their domestic and international employee benefit plans and compliance with federal and state law.
Before joining the firm, Patricia acted as Senior Manager of National Employee Benefits at Kaiser Foundation Health Plan, Inc. and formerly served as Senior Counsel-Benefits and Executive Compensation at AirTouch Communications, Inc. (now Vodafone).
Patricia also acted as Legislation Counsel on the Joint Committee on Taxation within the United States Congress working extensively on the Clinton health care proposal and other benefits legislation. Rachel represents clients in high-stakes, complex litigation. She has argued successfully in federal and state appellate courts and has been the lead drafter of briefs and dispositive motions in both state and federal court and the U.S. Supreme Court. Rachel’s experience litigating and advising clients covers a wide range of substantive areas. She focuses in particular on tough questions of constitutional law, statutory interpretation, and intellectual property. Rachel also maintains an active pro bono practice.
Prior to joining Orrick, Rachel served as a law clerk to Supreme Court Justice Stephen G. Breyer, Judge Cornelia T.L. Pillard of the D.C. Circuit, and Judge William A. Fletcher of the Ninth Circuit. Rachel received her J.D. from Yale Law School, where she served as a student director of the Supreme Court Advocacy Clinic and as Essays Editor of the Yale Law Journal. She graduated from Williams College and received master’s degrees from University College London and University of St. Andrews, which she attended as a Marshall Scholar.
