Molly McCafferty Senior Associate

Molly has extensive experience in all phases of litigation. She has shepherded witnesses and defendants through all stages of state and federal investigations, government enforcement actions, and civil and criminal trials. She has served a pivotal role in multiple federal jury trials, including arguing motions and formulating effective direct and cross examination strategies. She has defended high-profile clients in the technology and finance sectors in securities class actions, and represents clients in shareholder derivative suits and other shareholder-related disputes.

Molly regularly represents companies and their officers and directors in connection with investigations by the SEC, DOJ, FINRA and other state and federal agencies. She has defended clients in SEC and DOJ enforcement actions. Molly's litigation experience also includes defending against allegations of securities fraud, the False Claims Act, and mail and wire fraud.

Molly's pro bono experience focuses on the assisted reproductive technology space, where she has become a go-to strategic advisor. In addition to representing individuals at all stages of the ART lifecycle, Molly regularly counsels organizations affected by assisted reproductive technology and third-party reproduction. Molly has appeared on The Doctors and in the Wall Street JournalNew York Times, and New York Magazine commenting on regulation and litigation in the gamete donation industry. Most recently, Molly secured a favorable ruling from the FDA on behalf of her clients.

Isaac Sawlih Behnawa Managing Associate

Isaac draws upon his technical background in contextualizing complex issues into the elements of legal claims. Isaac is experienced in representing some of the world’s largest and most innovative companies through all phases of litigation in matters involving video-on-demand technology, patented software, and gaming system architecture. Tom Chen Of Counsel

Tom joined Orrick after serving for several years as an investigative attorney in the Office of Unfair Import Investigations at the U.S. International Trade Commission, where he was lead counsel representing the public interest in numerous Section 337 investigations involving allegations of patent infringement, trade dress infringement, and false advertising. During his tenure as an investigative attorney, Tom successfully first-chaired numerous evidentiary hearings and claim construction hearings, and he also was responsible for briefing all procedural and merits issues before the administrative law judges and the Commission.

Before his government service, Tom was associated with international law firms, where he successfully litigated life sciences patent matters involving large molecule and small molecule therapeutics in patent infringement disputes in district court, inter partes review proceedings before the U.S. Patent and Trademark Office, and patent appeals before the U.S. Court of Appeals for the Federal Circuit.

Early in his career, Tom served as a judicial law clerk to the Honorable Alvin A. Schall of the U.S. Court of Appeals for the Federal Circuit, and to the Honorable Leonard P. Stark, then of the U.S. District Court for the District of Delaware.

Tom earned his law degree from the University of Virginia School of Law, where he was a member of the Virginia Law Review and the Virginia Journal of Law & Technology, and won numerous internal and external writing awards and competitions. Before law school, Tom completed a master’s degree in biotechnology from the Johns Hopkins University and a bachelor’s degree in chemistry and pharmacology from Duke University.

In 2020, Caleb graduated from the University of California, Irvine School of Law. While in law school, Caleb co-authored a brief argued before the U.S. Court of Appeals for the Ninth Circuit and served as Editor for the UC Irvine Law Review.

Prior to law school, he worked for several years at J.P. Morgan Chase with positions in corporate finance, mortgage banking, credit card operations, and compliance.

In addition, he regularly represents underwriters and purchasers of both public and privately placed debt, regularly serving as underwriters’ counsel and bank counsel.
