Barry Levin Partner

San Francisco; New York

Barry is known in the market as “one of the most accomplished litigators,” “very effective in pursuing compelling themes and tearing down witnesses with polite cross-examination” (2017 Benchmark Litigation), and as "a real seasoned veteran of high-stakes litigation" (2020 Chambers USA). Barry has also been commended by his peers as a "fabulous lawyer" who is "very well regarded and really knows the area" (2016 Chambers USA). 

Barry has broad first chair experience in trial and arbitration, ranging from trial counsel for Johns-Manville Corporation in its coverage litigation involving asbestos-related bodily injury claims to successful domestic and international arbitrations on behalf of financial institutions, hospitals, and hospitality companies.  

Over the past 8 years, Barry has developed extensive experience in issues arising out of the financial crisis, including a range of issues relating to mortgage backed securities and lending practices.

He is a frequent lecturer in the area of litigation, insurance coverage and law firm management. Prior to joining Orrick, Barry was a shareholder at Heller Ehrman LLP.

Herbert Levine Counsel

New York

He has represented U.S. and multi-national corporations engaged in a wide variety of industries, including retailing, radio and television broadcasting, automotive parts, printing and publishing, refining and packaging of petroleum products, manufacturing and distribution of wines, spirits and related products, hotels, food service, financial institutions, passenger airline, and freight forwarding companies.

Herbert has extensive experience in negotiating collective bargaining agreements, and has represented clients in a broad range of labor matters, including: union election and unfair labor practice cases, arbitrations and strike related matters. His practice also includes federal and state court and administrative agency litigation covering employment discrimination, wrongful discharge, ERISA, and wage-and-hour matters.

He has participated in establishing security programs for clients, helped design benefit plans, employment handbooks, and worked with clients on affirmative-action compliance reviews and safety and health matters. He has drafted and negotiated employment agreements, and has done extensive work in counseling and representing clients in merger and acquisition problems including negotiations with adverse parties, unions, and insurance carriers.

Herbert started his practice as an attorney for the National Labor Relations Board, and then worked for Proskauer, Rose, Goetz, & Mendelsohn. From 1972 to 1990, Herbert was a partner at the firm of Baer, Marks & Upham, where he chaired the employment law department, and was instrumental in building a labor and employee benefits practice. 

He joined Orrick in 1991, and continued as a partner until 2002, when he retired from the partnership in order to devote more of his time to family obligations. He has continued to practice with Orrick since that time as counsel.

David Litterine-Kaufman Partner

New York

David is a partner in Orrick's Complex Litigation and Dispute Resolution Practice Group based in New York and co-head of Orrick's Bankruptcy Litigation Working Group. His practice focuses on representing lenders, underwriters, and large public and private companies in financial disputes throughout the litigation process, from pre-litigation dispute resolution to success at trial.

David has litigated high-stakes bench and jury trials and pretrial proceedings involving nine-figure secured claims in bankruptcy, multi-billion dollar securities offerings, complex long-term supply contracts, and valuable trademarks.

David also has years of experience litigating distressed asset and syndicated loan trades, contract disputes, and residential mortgage-backed securities issuances for both plaintiffs and defendants. David's background in computer science and mathematics allows him to quickly master complex financial transactions and craft effective litigation strategies for his clients.

Before joining Orrick, David was an associate at Cravath, Swaine & Moore LLP.

Lisa Lupion Partner

New York

She begins by gathering an in-depth understanding of her client’s business and goals, and then evaluating the specific issue at hand, so that whether navigating a counseling issue or a complex litigation, she can understand every possible angle and design the best possible solution.

Lisa, who serves as a member of Orrick's Management Committee, regularly litigates a broad range of employment issues in court, administrative agencies, and arbitration. Lisa also helps companies at all stages of development avoid litigation or prevent a single-plaintiff matter from escalating to a class action. She has successfully handled a number of high-stakes arbitrations and internal investigations. In addition, she offers counseling on discrimination, harassment, equal pay, wage and hour issues, disability accommodations, termination and compensation.  Lisa regularly advises clients on a variety of employment-related issues, including human resources policies and procedures, offer letters, severance agreements and employee termination.

Carl Lyon Partner

He has long-standing relationships with a great number of utility clients that span many years and complex transactions, advising them on numerous taxable, tax-exempt, and tax-advantaged financings of all types for electric, gas, water and waste water projects and in restructuring and work-outs. These projects include five different nuclear plants, with financing through both the public capital market and through the U.S. Department of Energy.

Carl was one of the leaders in the development of joint action agencies among municipal utilities. He worked on legislation in 20 states to authorize their formation and testified before legislatures and legislative committees in many of these states. He drafted the first modern indenture for cooperative utilities which served as the model that is currently used by almost every generation and transmission cooperative. He worked with TVA in their exit from the Federal Financing Bank program in the 1980’s and in their financings since then. Carl worked with the major generation and transmission cooperatives that have exited the RUS program in structuring and financing their exit.

Carl has also worked with virtually every major investment banking firm and most major domestic and international banks.
