On March 19, 2025, the German Federal Labor Court (BAG) handed down a landmark ruling (10 AZR 67/24) that is expected to have a significant impact on the design of employee participation programs. It ruled on a regulation that stipulates that vested virtual stock options (ESOPs) immediately lapse when an employee resigns.
