Emily S. Emily advises clients on an array of privacy and data management matters, helping clients navigate the complex web of privacy laws, rules, regulations and best practices governing the collection, use, transfer and disclosure of data and personal information. Emily works closely with client business teams and in-house counsel to assess and manage privacy risks, design and deploy compliance programs and implement privacy-by-design approaches to address key compliance objectives while supporting each client’s data innovation strategies and the development and use of cutting-edge digital technologies. She frequently guides child- and student-directed service providers through the complexities of compliance with the Children’s Online Privacy Protection Act (COPPA), the Family Educational Rights and Privacy Act (FERPA), California’s Student Online Personal Information Protection Act (SOPIPA) and similar state student privacy laws and advises companies across the industry spectrum as they work towards compliance with the California Consumer Privacy Act (CCPA). She also represents clients subject to regulatory investigations and litigation involving a spectrum of federal and state laws, including under Section 5 of the Federal Trade Commission Act (FTC Act), COPPA, the Fair Credit Reporting Act (FCRA), Gramm-Leach-Bliley Act (GLBA), the U.S.-E.U. Privacy Shield Program, the California Online Privacy Protection Act (CalOPPA) and others.

To make the CCPA more accessible, Emily developed Orrick's CCPA Readiness Assessment Tool. The tool provides companies an opportunity to test their compliance with the CCPA and similar laws as a first step to constructing their strategic compliance roadmap.

Emily also has an active consumer protection practice, focused on marketing and promotional issues. She counsels clients on interest-based advertising, sweepstakes and marketing promotions, retail sales and e-commerce platforms, advertising substantiation, new media and social media integration, and SMS text messaging and telemarketing, including matters involving the Telemarketing Sales Rule (TSR), the Telephone Consumer Protection Act (TCPA), the Restore Online Shoppers’ Confidence Act (ROSCA) and state and federal consumer protection statutes.

Emily is a Certified Information Privacy Professional in both U.S. and European privacy law (CIPP/US and CIPP/E) and member of the International Association of Privacy Professionals (IAPP) Publications Advisory Board. She is a frequent speaker on data privacy matters, with a particular focus on children’s privacy (COPPA), student data privacy and EdTech. She was featured as an “Up and Coming” Privacy & Data Security attorney by Chambers USA 2018 and 2019.  In 2016, Law360 named Orrick’s Cyber, Privacy & Data Innovation practice “Practice Group of the Year” in the data privacy category. In 2019, Chambers USA ranked Orrick’s practice in Band 1 and named Orrick the Privacy/Data Security Law Firm of the Year.

Jacopo Taddei is an Italian qualified lawyer, Associate in the Milan office and member of the European Corporate Group. Jacopo has solid experience in M&A transactions, corporate governance and in drafting and negotiating complex, cross-border commercial agreements (such as outsourcing, distribution, agency, franchising and supply agreements).

Jacopo also has specific experience in criminal liability of legal entities, and assists some of the most important Italian companies - some of which are listed in Italy or abroad - in drawing up compliance programs in accordance with Italian Legislative Decree 231/01. Yoshi Takatori is head partner of Orrick's Global Japan practice and Tokyo's Litigation Group. His practice focuses on cross-border dispute resolution including multi-jurisdictional litigation and international arbitration on intellectual property, product liability, anti-trust, FCPA and UKBA and compliance investigation and disputes involving labor laws. Yoshi has been recognized by numerous international publications such as being ranked Band 1 as a Dispute Resolution lawyer in Chambers Asia Pacific and recognized as a leading individual for Dispute Resolution and Intellectual Property for Asia Pacific Legal 500. He has also been recognized by the Financial Times as a Top 10 Legal Innovators for Asia-Pacific in 2019.

Yoshi has an active practice advising and counseling multi-national Japanese companies and the Japanese Government, on proactive cybersecurity program development and strategy. He also advises on cybersecurity issues in the context of adversarial proceedings and dispute resolution. He is an Editor and Co-author of “Cyber Security Strategy for Litigation and Compliance,” which is the first book in the Japanese legal marketplace discussing multi-stakeholder risk management strategies relating to external cyber-attacks and insider cyber trade secret theft. He is regularly consulted by leading media outlets, including TV and newspapers, and quoted, in major business publications on cybersecurity issues and insights.

Yoshi's previous experience includes:

  • representing several Japanese companies in the Cresvale Securities (Princeton Bonds) incident, which victimized over 150 Japanese companies, and played a central role in the trial and settlement procedures in Japan and New York;

  • successfully representing clients in a number of IP-related dispute resolutions involving trademark, counterfeit and patent issues in U.S., Asian and EU jurisdictions. In recent years he has gained attention for victories in compensation for damages of trademark infringement in foreign countries through application of foreign law and Japanese law through the Act on General Rules for Application of Laws; and

  • numerous achievements in cross-border enforcement, trial and international arbitration such as obtaining a temporary restraining order in Japanese court based on the certified decision in California that includes JPY280 billion in punitive damages.

In addition, Yoshi is listed as a recommended arbitrator for the Japan Commercial Arbitration Association (JCAA) and listed on SIAC's Panel of Arbitrators and KCAB’s Panel of Arbitrators and as a Specialist Mediator at Singapore International Mediation Center (SIMC). He is a qualified FCIArb and serves key positions in the international arbitration field such as being the executive director for the Japan Association of Arbitrators, and co-convener of the Japan Chapter of the Chartered Institute of Arbitrators (CIArb.).

Darren Teshima, Co-Leader of Orrick's Complex Litigation and Dispute Resolution practice, helps clients intelligently manage risk and assert their rights through litigation. Specializing in the technology and finance sectors, Darren litigates high stakes commercial disputes, focusing on insurance coverage disputes. He has successfully handled litigation related to residential mortgage-backed securities (RMBS), directors & officers (D&O) coverage and cyber insurance for some of the largest data breaches in history. For example, he recently defended Credit Suisse at trial in a case brought by monoline insurer MBIA, one of the few post-financial crisis RMBS cases to go to trial.

Darren also helps clients avoid litigation by crafting innovative strategies that address cutting-edge cyber, data and cryptocurrency concerns; as well as D&O and professional liability. From January 1989 to September 1990, he worked as the Italian resident lawyer for Werbel, McMillin & Carnelutti, a U.S. law firm based in New York City.

From October 1990 to December 1997, he was a partner at Studio Legale Carnelutti in Milan. From January 1998 to December 2008, he was a partner at Vita Samory, Fabbrini e Associati, an Italian law firm based in Milan.
