Richard Jacobsen Partner

New York

Rich serves as lead counsel for Credit Suisse’s entire residential mortgage-backed securities (RMBS) docket in federal and state courts throughout the country. He is lead counsel for Goldman Sachs in two RMBS cases in the SDNY. For nearly a decade, he has been lead counsel for Ocwen Financial Services in all matters concerning its market-leading business servicing loans in residential mortgage-backed securitizations. He is currently lead counsel for Nationstar Mortgage LLC d/b/a Mr. Cooper in a breach of contract action pending in the Delaware Court of Chancery. Rich has also frequently represented companies with respect to disputes involving the distressed debt trading market, including Jefferies and Citibank, and frequently tries nine figure disputes in the most important bankruptcy jurisdictions in the United States for clients such as UBS and Blackstone.

Thomas Kidera Partner

Tom represents Orrick's renewable energy and infrastructure clients in a vast array of commercial, warranty, and construction litigation matters throughout the U.S. and around the globe, previously having served as a member of the Orrick team that represented Hemlock Semiconductor (a leading producer of solar-grade polycrystalline silicon) in a host of litigations and proceedings arising from the breach of its long-term supply agreements by counterparties. His practice touches all types of renewable energy disputes from PPA litigation, to development and construction claims, to component supply and performance disputes, and everything in between.

In addition to representing his clients in courts and confidential arbitrations, Tom regularly provides pre-litigation counseling to Orrick's renewable energy and infrastructure clients, helping them manage their enterprise liability and pursue and defend claims through mediation and pre-dispute procedures, often resolving matters amicably before they devolve into full litigation or arbitration.

Tom also has litigated structured finance issues for his entire career, representing securitization sponsors and loan servicers in an array of litigations from securities fraud and loan repurchase disputes to ERISA and consumer class actions, also consulting and advising on the interpretation of securitization documents and events of default.

In addition, Tom represents audit firms and accountants in regulatory proceedings commenced by the SEC and the PCAOB along with related civil litigations. Barry Levin Partner

David Litterine-Kaufman Partner

David is a partner in Orrick's Complex Litigation and Dispute Resolution Practice Group based in New York and co-head of Orrick's Bankruptcy Litigation Working Group. His practice focuses on representing lenders, underwriters, and large public and private companies in financial disputes throughout the litigation process, from pre-litigation dispute resolution to success at trial.

Richard A. Martin Senior Counsel

In his previous role at Orrick, Dick was a partner in the New York office, and a member of the Securities Litigation, Investigations and Enforcement Group. His practice focused on accountants’ liability, securities and commercial litigation, as well as arbitration and international and domestic white-collar criminal law. Dick is now Senior Counsel at Orrick, and while he continues to contribute to the work of those groups, his primary focus is on assisting our pro bono client, the Center for Reproductive Rights.

Dick has been involved in litigation in the state and federal courts of the United States, Europe, Asia and the Americas for more than 40 years. From June 1987 to August 1990, Dick served as Special Representative of the Attorney General, located at the United States Embassy in Rome, Italy. There he represented the Department of Justice in Europe and handled extradition and mutual assistance matters throughout Europe and North Africa, among other duties. In August, 1990, Dick’s contributions to the Administration of Justice in Italy were recognized when he was named “Commendatore al Merito della Republica Italiana”, the Italian Legion of Honor.

Prior to transferring to Rome, Dick served as an Assistant United States Attorney for the Southern District of New York, from January 1980 to June 1987. Dick received numerous commendations for his work in the United States Attorney’s Office, including the Distinguished Service Award from the Department of Justice for his leadership role in the case known as the “Pizza Connection”. Dick has been fluent in Italian since he was awarded an AFS scholarship for the school-year program in Naples, Italy, where he attended Liceo Classico.

Harry McAlevey Managing Associate

Harry has broad experience representing a wide array of clients in all stages of litigation. He's worked with clients in bet-the-company disputes from the pre-litigation stage through motion practice, discovery, expert depositions, summary judgment motions, extensive pre-trial preparations, trials, and appeals. Separate from his successes in both state and federal litigation, Harry has also helped guide clients big and small through arbitration disputes.
