Most recently, Khai was lead trial counsel for EFG Bank and Erste Abwicklungsanstalt (which acquired the assets of former WestLB) in their lawsuit against AXA Equitable Life Insurance Company in the Southern District of New York, arising out of Equitable’s cost of insurance rate increase in 2016. EFG and EAA sought close to $100 million in damages. After several years of litigation, the case settled over the weekend before jury selection on very favorable terms. The settlement continued a string of recoveries Khai has achieved for clients pursuing claims against carriers that raised their cost of insurance rates.
Khai was lead trial counsel for EFG, EAA, and Obra Capital in their lawsuit against John Hancock Life Insurance Company in the Southern District of New York, arising out of John Hancock’s cost of insurance rate increase in 2018. EFG, EAA, and Obra sought over $100 million in damages. The case settled the evening before jury selection on very favorable terms.
Last year, Khai was lead trial counsel for a life insurance agent sued for fraud in connection with a life settlement transaction. The plaintiff sought over $10 million in damages. Following a one-week trial, the jury returned a complete defense verdict, and the case settled before judgment was entered.
Khai was lead trial counsel in a two-week bench trial in an action against a school district arising out of its allocation of $417 million in bond funds. The plaintiffs, led by a taxpayer association, sought $90 million for construction of a new school. After navigating a year-long political imbroglio and defeating plaintiffs’ summary judgment motions following a defense that Judge Pressman described as “brilliantly argued,” the case proceeded to a trial that resulted in a decision in favor of the district on all claims. Khai also defended and argued the appeal, in which the trial court’s judgment was affirmed.

Colleen has extensive experience drafting and negotiating a wide variety of complex commercial agreements, including: intellectual property and data licenses; software development and license agreements; IT-focused services agreements, including consulting, development, hosting, and various “as-a-service” agreements; manufacturing and distribution agreements; joint venture and joint development agreements; and technology and intellectual property acquisition and disposition agreements. Colleen has been involved in numerous pro bono activities, including: volunteering with voting rights and voter protection organizations; advising Georgetown’s Halcyon House social entrepreneurship fellows on intellectual property matters; hosting a start-up IP licensing webinar; and drafting and negotiating agreements for a PSA supporting equal wages for women.
Before becoming an attorney, Colleen spent several years working as a computer hardware and software engineer and performing research at a scientific think tank.

Sarah has particular expertise defending challenges to overdraft fees, including challenges to authorize positive, settle negative (“APSN”) transactions, and has represented Capital One, U.S. Bank, First Hawaiian Bank, and Union Bank in putative class actions challenging APSN fees. Separately, Sarah has defended two large national banks in enforcement actions related to overdraft fees and obtained a non-public resolution of voluntary remediation.
Sarah also has a robust practice defending both small and large companies against allegations of food mislabeling. She has successfully defended or reached favorable settlement terms regarding challenges to “all natural,” “no sugar added,” and “non-GMO” claims.

Ashley works with litigation attorneys and third party vendors to manage the review and production of documents relevant to investigations and litigation. This work includes using early case assessment technology to analyze, categorize and cull data. She also manages teams of skilled professionals performing document review, redaction, analysis, production and drafting privilege logs. Ashley assists the litigation team to prepare for trial, including drafting deposition summaries, factual memoranda and exhibit charts. She also works with practice office attorneys on transactional tasks, including contract review and due diligence.

Dan is experienced in Hatch-Waxman litigation, including disputes involving drug treatments for cancer and HIV. Dan is also experienced in biologics litigation and counseling, representing clients on matters involving expression vectors, antibodies, gene therapies, and CAR T-cell therapies. Dan’s experience includes litigating patents directed to recombinant DNA technology, complex manufacturing processes, small molecule compounds, crystalline forms, methods of treatment, oral dosage formulations, injectable formulations, and fixed dose combination products.
Dan has contributed to numerous victories on behalf of our life science clients, including a complete win in a multi-patent Hatch-Waxman trial for a client’s blockbuster cancer therapy, favorable claim constructions in numerous cases, and obtaining a special master’s report and recommendation for attorneys’ fees for the opposing parties’ exceptional discovery misconduct.
