Donald Daybell, a senior attorney in Orrick's Orange County office, is a member of the Intellectual Property Group. Mr. Daybell's practice is focused on high-stakes patent litigation, with an emphasis on trials in the US Patent and Trademark Office (PTO). 

Mr. Daybell is lead or backup counsel on over 60 Inter Partes Reviews before the PTO, and has spoken frequently about the America Invents Act and the PTO trial procedures enacted by this ground-breaking legislation. 

Mr. Daybell also has substantial experience in all aspects of patent litigation. He has managed the day-to-day activities of complex patent cases, has taken and defended numerous depositions, has presented witnesses at trial, and has argued matters before various tribunals, including district courts and the International Trade Commission.

Mr. Daybell has experience in litigating and prosecuting patents in various technical fields, including semiconductors, computer software and hardware, databases, financial services, e-commerce, business methods and medical devices. His experience further includes preparing requests for ex parte re-examination and prosecuting re-examination requests with the PTO. His experience also includes providing counseling and opinions regarding issued patents, and conducting due diligence reviews of intellectual property.

Don Keller, a partner in the Silicon Valley office, is a member of the Technology Companies Group.

Don advises high growth technology companies, public companies, venture capital firms and investment banks. He has advised clients on more than 60 public offerings, 75 acquisition transactions and several hundred venture financings.

Chambers USA recognized Don for his work in the areas of Venture Capital and Startups & Emerging Companies, noting he "is valued for his knowledge of venture capital firms and his strength in advising technology companies on public offerings, acquisition transactions and venture financings. One client insists that 'I would not dream of starting a company without him as my outside counsel.'" (2018)  He is ranked Band 3 for both Startups & Emerging Companies and Venture Capital (2019).

Don has held many leadership positions at Orrick. Don currently leads Orrick’s Technology and Life Sciences Sector, which is one of the three focus areas (along with energy and finance) for the firm. Don is a former member of Orrick’s Board of Directors, served as head of the firm’s global corporate practice,  served as head of the firm’s Silicon Valley Office and served as co-head of the firm's diversity efforts. 

Don also previously served for many years on the Executive Committee of Venture Law Group.

Donna Long is an associate in Orrick's Intellectual Property Group.  She focuses her practice on patent litigation covering a broad range of technologies including internet and mobile applications, wireless communications, electronic security, and industrial design.

Donna's patent litigation experience includes motion practice, depositions, and working with experts. She also has worked on patent prosecution, inter partes reviews, copyright and trademark disputes, and antitrust litigation.

Donna also devotes her time to various pro bono matters. She has defended depositions of clients in Section 1983 civil rights and employment discrimination cases. During law school, Donna worked at the Juelsgaard Intellectual Property and Innovation Clinic, where she represented a recycling nonprofit in the rulemaking process for exemptions from the Digital Millennium Copyright Act relating to circumvention of digital locks.
