Bankruptcy
- The Governor of Primorski Krai on 29 June 1999 issued Resolution No. 282 "On Introducing Amendments to the Resolution of the Governor of Primorski Krai No. 522 dated 29 October 1998 'On Confirming the Regulation on the Krai Administration's Directorate for Affairs of Insolvency (Bankruptcy) of Enterprises'".
The amendments introduced by this Resolution further specify the functions of the Krai's Directorate for Affairs of Insolvency (Bankruptcy) of Enterprises. Additional functions, for engaging in a process of multilateral co-ordinated regulation of debtor enterprises' accounts receivable and accounts payable, have been given to the Directorate.
Economy
- On 6 December 1999 the Vladivostok Administration adopted Regulation No. 2094 "On Registration Fee for Individual Entrepreneurs."
The document determines the rate of the registration fee to be charged to individual entrepreneurs in an amount equal to the minimum wage. It also determines the fee amount for any cancellation of the state registration, and the amount of the concession granted to retired individuals.
W.W.II veterans, class I and class II invalids and families having many children are exempt from the payment of the registration fee.
- On 2 December 1999 the Governor signed Regulation No. 554 "On Licensing of Motor Vehicle Trade in Primorski Krai Territory"
This regulation establishes the procedure for licensing the motor vehicle trade occurring in the territory of the Primorski Krai, pursuant to the Statute on Licensing the Motor Vehicle Trade approved by the Russian Federation Government of 5 November 1999.
- On 25 November 1999 the Duma of the Primorski Krai adopted Regulation No. 583 "On Granting the Primorski Krai Administration the Right to Issue a Guarantee to ZAO "The Far East Industrial and Investment Company "Energia Vostoka"" and OAO "Primorskugol" in connection with a Budgetary Loan from the Ministry of Finance of the Russian Federation"
The document establishes the loan in the amount of 116.4 million Rubles for the development of the Rakovsky coal mine and Section 2 of the Pavlovsky-2 coal mine.
- On 5 May 1999 the Head of the Municipal Unit of Ussuryisk City and Ussuryisk Region of Primorski Krai signed Resolution No. 490 "On Promoting Development of New Manufactures on the Territory of Ussuryisk City and Ussuryisk Region."
This Resolution sets forth measures for promoting development of local economy, providing beneficial conditions for investments and business revival, and securing employment of inhabitants. Preferences in relieving the tax burden will be given to investments in industrial manufacturing, farm production and processing of agricultural products.
Businesses with such structure of output, which create at least 10 new jobs, shall be exempt from land rent for the first year of their business activity. The Resolution also provides for other support to the above enterprises.
Environment
- On 17 August 1999 the Governor of Primorski Krai signed Resolution No. 361 "On Organization and Procedure of Implementing State Control and Supervision of the Waste Disposal in Primorski Krai by the Primorski Krai Administration."
The document approved a Regulation setting out the procedure of the state control and supervision over the waste disposal in Primorski Krai by the regional administration. The state control and supervision is aimed at prevention of negative impact of industrial and residential waste on the environment and human health, as well as recycling such waste.
- On 5 July 1999, the Governor of Primorski Krai signed Resolution No. 299 "On Establishing 'Udegeyskaya Legend' National Park."
The document accepted the proposal of the Primorsk Forestry Agency to establish "Udegeyskaya Legend" national park in the territory of Krasnoarmeisk Region using the land of the state forest fund of Roschinsk forestry farm.
The Resolution establishes that the areas containing natural resources shall be included in the park area upon completion of their extraction, expiration of the subsoil license and re-cultivation of the affected areas.
Foreign Investment
- On 9 August 1999 Vladivostok City Administration adopted Resolution No. 1413 "On Regulation of the Employment of Foreign Labor in Retail and Consumer Services on the Territory of Vladivostok City."
For the purpose of regulating the employment of foreigners on the territory of Vladivostok City, this document prescribes to employ only highly skilled foreign citizens as hired manpower (commercial agents) in areas of retail and consumer services. Any foreign citizens engaged in trade or consumer service must be registered with the tax authorities located in place of their activities, provided that such citizens reside in the Russian Federation for more than 183 days per calendar year.
Quotas to employ foreigners in the retail and consumer services sectors shall be determined annually.
- The Vladivostok City Administration on 26 May 1999 adopted Resolution No. 975 "On the Creation of Favourable Conditions for Conducting Investment Activity and On Offering Exemptions from Payment of Taxes".
Under this Resolution, an exemption from payment of the portion of the property tax which accrues to the city budget is granted as of 1 January 1999 (for a period of not more than one year) to enterprises in the hotel business and in the services sphere which meet the following criteria: (1) the participation interest of foreign investors in the charter capital of the enterprise is no less than 50 percent; (2) the total amount of foreign investment in the enterprise is no less than US$ 50 million, based on the Central Bank of Russia's exchange rate at the moment that the investment was conducted; and (3) the enterprise employs no fewer than 270 Russian workers.
Government
- The Governor of Primorski Krai on 5 July 1999 issued Resolution No. 291 "On Economic Conditions for the Implementation of the 'Borders of Primorye' Program in 1999".
The undertakings envisioned in the Resolution are directed at the implementation of the Primorski Krai Law "On Cossacks in Primorski Krai" and the "Borders of Primorye" Program, which was confirmed by Resolution No. 132 of the Primorski Krai Duma dated 14 July 1998.
This Resolution enumerates the bodies which are responsible for the tasks listed therein and defines their responsibilities. In particular, there are plans to organise common work for the participants in individual housing construction; to organise a business development program to provide theoretical training to developers; and to organise a mutual support society to arrange small credits during the creation of entities.
It is also proposed to include funds for the implementation of the "Borders of Primorye" program, in the amount of 3,600,000 roubles, in the draft Primorski Krai Law "On Introducing Amendments and Additions to the Primorski Krai Law 'On the Krai's Budget for 1999'".
International Relations
- The Governor of Primorski Krai on 9 June 1999 issued Resolution No. 259 "On Conducting the Exposition 'EXPO NEAR 21'".
In order to promote the products of producers from Primorski Krai on the markets of the Northeast Asian countries, and to attract foreign investment in the economy of Primorski Krai, the Toyama prefecture's proposal for Primorski Krai to participate in the exposition EXPO NEAR 21, "Economic Co-operation in Northeast Asia," was accepted. The exposition will take place from 13 to 15 October 1999 in the city of Toyama, Japan.
The Resolution appoints the exposition management and organisational committee for Primorski Krai's participation in the exposition.
Labor
- On 18 November 1999 the Governor signed Regulation No. 525 "On Approval of the Quotas for Foreign Employees in Sales and Gorshenin Service on the Territory of the Primorski Krai for 2000"
The quotas are determined by the cities and regions of Primorski Krai in sales, public catering and consumer services.
Land
- On 7 October 1999 the Primorski Krai Committee for Land Development issued Letter No. 18/614/03-16 "On Documents Required for the Registration of Rights to Land Share Interests upon Transfer."
Primorski Krai Committee for Land and Land Development issued this Letter to clarify what documents are required for the registration of rights to a land share interest when it is sold or disposed of in some other manner.
- On 15 September 1999, Duma of the City of Nakhodka adopted Resolution No. 87 "On Adopting the Regulation "On Land Payments in Nakhodka in 1999."
The Resolution approves the zoning of Nakhodka's land according to its economic value and land payments for such zones. The Resolution defines the specifics of payments for land, the use of proceeds, and lists specific privileges applicable to the land payments.
- On 2 September 1999 the Primorski Krai Committee for Land and Land Development issued Letter No. 18/558(03-12) "On Issues of the State Registration of Transactions with (and Leases of) Land."
The document clarifies that state registration of rights to land and transactions with land (including leases) performed prior to the effective date of the Federal law "On State Registration of Rights to Real Estate and Transactions with Real Estate" is valid. The Letter also clarifies that land ownership interests (participatory interest) prior to the allocation of specific land plots are not considered to be real estate for the purposes of Article 130 of the Civil Code of the Russian Federation.
The Letter addresses allocation of land plots as result of transformation of a co-ownership interest into title to actual land plots. It also lists documents necessary for the state registration of rights to inherited land co-ownership shares (participatory interest).
- The City Administration of Vladivostok on 30 June 1999 issued Resolution No. 1216 "On Regulation of Land Relations and Allocation of Functions".
In order to bring the normative acts of the Vladivostok City Administration into accordance with existing law, a series of documents were repealed. The Resolution establishes a Temporary Procedure for regulating land relations and for allocating functions regarding land issues on the territory of Vladivostok, and establishes a Temporary Provision on the procedure for granting and seizing land in Vladivostok.
The Vladivostok City Committee on Land Resources and Land Management has been granted the power to prepare draft agreements for citizens and legal entities to rent and purchase land parcels under adopted Resolutions and by introducing amendments and additions in consultation with the City Directorate of Architecture and Urban Construction.
- The City Administration of Vladivostok on 22 April 1999 issued Resolution No. 731 "On Establishing the Purchase Price of Land Beneath Privatised Buildings and Structures in the City of Vladivostok".
The purchase price for land beneath privatised buildings and structures in Vladivostok is established as an amount 20 times the amount of the land tax per square unit of land parcel that was effective at the moment the purchase application was accepted.
The Resolution establishes that for its purposes, privatised buildings and structures are objects, the property rights over which were transferred directly from the state (or body of local self-government) to the entity which applies to purchase the land thereunder.
- The City Administration of Vladivostok on 22 April 1999 issued Resolution No. 730 "On Establishing the Land Tax Rate for 1999".
In 1999, the land tax rate in the city of Vladivostok is established with an magnifying coefficient of 2, relative to the rate applied in 1998. The tax rate for agricultural land is established at the same level as the rate applied in 1998.
The Resolution establishes that any document which confirms the factual use of the land parcel (including documents relating to the building (structure), a technical certificate from the Bureau of Technical Inventorization, materials from inventories of structures and land, data from land survey records, and other documents) shall be the basis for imposing taxes on land parcels if the rights of citizens and legal entities over such parcels are not confirmed.
Natural Resources
- On 20 October 1999 the Governor of Primorski Krai signed Regulation No. 487 "On Setting up an Interdepartmental Committee for Coordinated Control over the Export of Valuable Types of Timber."
This Regulation set up an interdepartmental committee for coordinated control over the export of valuable types of timber, approved its composition, the Statutes of the Interdepartmental Committee, and the List of Documents required for the issuance of a license for the export of valuable types of timber.
- On 20 October 1999 the Governor of Primorski Krai signed Resolution No. 488 "On Approval of Organizational Principles for Sea Urchin Harvesting in Primorski Krai."
This Resolution approves Regulations for Sea Urchin Harvesting in Primorski Krai, which sets forth the general procedure for holding a tender to choose among potential urchin collectors, as well as the basic management and control principles of urchin harvesting and marketing, and determines the harvesting techniques and instruments.
- On 1 September 1999 the Mayor of Nakhodka City signed Resolution No. 860 "On the Use of Subsoil and Payment for Licenses to Extract Common Minerals on the Territory of Nakhodka City."
This Resolution regulates payment procedures for the right to extract common minerals, and determines the rate of payment. It establishes that the lump sum payments for the right to extract common minerals shall be made only by those enterprises which have been granted a license for their extraction pursuant a tender or auction.
- The Governor of Primorski Krai on 29 June 1999 issued Instruction No. 808-r "On Apportionment of Timber Felling Areas for Short-term Use in 1999".
On the basis of submissions from the Primorski Krai Forestry Directorate, which were prepared in consultation with local municipalities, the Instruction apportions unclaimed timber felling areas under a procedure for short-term use in order to satisfy the timber needs of budget institutions, agricultural organisations, and the populations of Anuchinskiy, Dalnegorskiy, Dalnerechenskiy, Kirovskiy, Lazovskiy, and Mikhailovskiy districts.
- The Governor of Primorski Krai on 15 June 1999 issued Resolution No. 261 "On the Transfer of Forest Parcels for Use by Agricultural Organisations Free of Charge".
In order to ensure that agricultural organisations' own needs for timber and other forest resources are met, the Resolution confirms a list of agricultural organisations and of forest parcels, previously in the possession of such organisations, which are now given to the organisations for their use free of charge.
The assignment of timber and other forest resources to agricultural organisations to satisfy their own needs will be conducted free of charge within the limits established by Resolution No. 586 of the Governor of Primorski Krai "On Norms for the Use of Forestry Resources for One's Own Needs" dated 21 December 1998.
Other
- On 24 November 1999 the Duma of the Primorski Krai adopted Law No. 74-KZ "On Protection of the Primorski Krai Population and Territory from Natural and Technical Emergencies"
The document is intended to provide a legal basis to prevent emergency situations on the territory of the Primorski Krai, to reduce the damage caused by emergencies, and to eliminate the consequences of such emergencies.
The law outlines the powers of governmental and municipal bodies in case of emergencies, and ensures accessibility of information during such emergencies. The document contains the basic organizational and legal provisions for protecting the public from natural and technical emergencies.
- Primorski Krai Law No. 55-KZ "On the Procedure for Presenting Information on the Activities of the Bodies of State Authority of Primorski Krai in the Mass Media" dated 6 July 1999.
This law was adopted by the Primorski Krai Duma on 16 June 1999.
The law regulates the relations arising in connection with the mass media's distribution of materials or reports on the activities of the bodies of state authority of Primorski Krai.
In particular, the law defines: (1) the time period within which information on certain events defined in the law must be presented; (2) requirements which are imposed on informational and informational-educational programs; (3) the procedure for mass media appearances by Duma deputies; and (4) the conditions for presenting information on the activities of the bodies of state authority of Primorski Krai.
- The Administration of Vladivostok City on 24 May 1999 issued Resolution No. 940 "On Confirming the Regulation on the Department of Registration of Enterprises in the Vladivostok City Administration"
The Department of Registration of Enterprises has been granted the right to conduct the registration of subjects of entrepreneurial activity in the name of the Vladivostok City Administration, irrespective of the enterprises' legal form and the spheres of their activity. The Regulation which is confirmed by this Resolution defines the object of the Department's activity, the Department's rights and obligations, the procedure for appealing the actions of Department officials, and also regulates issues of audits, book-keeping, liquidation and reorganisation of the department.
Property
- On 11 August 1999 the Governor of the Primorski Krai signed Resolution No. 353 "On Creating the Single System of State Registration of Rights to Immovable Property and [Registration of] Legal Entities in Primorski Krai."
The Resolution was issued to regulate state registration of legal entities in the territory of Primorski Krai. The Resolution empowers Primorski Krai Registration Center to register companies regardless of their business form and the purposes of their activities as well as other business entities operating in the territory of Primorski Krai.
Tax
- On 7 December 1999 the Duma of the Primorski Krai adopted Law No. 77-KZ of the Primorski Krai "On Tax Rates for Gambling Businesses"
The document determines the uniform tax on the territory of the Primorski Krai for the period of one year as multiples of the minimum wage established by the federal law.
- On 12 October 1999 Vladivostok Administration adopted Resolution No. 1743 "On Establishing the Rates of the Tax on Property of Individuals."
Vladivostok Administration established the tax rates on buildings and construction depending on their value. The tax rates vary from 0.1% to 2.0%. It also determined the rates of tax on aircraft and boats, as listed in the appendix to the Resolution.
- On 20 August 1999 the Governor of the Primorski Krai issued Resolution No. 372 "On the Sources of and on Using the Special-Purpose Budget Fund for Restoration and Protection of Water Objects in Primorski Krai."
This Resolution determines the sources and use of the Budget Fund for Restoration and Protection of Water of the Primorski Krai. The Resolution also lists the bodies authorized to manage the Fund's finances.
- On 11 August 1999 the Governor of Primorski Krai signed Law No. 60-KZ of Primorski Krai "On Amending Primorski Krai Law "On Rates and Privileges on Profit Tax Payments for Enterprises and Organizations and on Tax of Enterprises' Property"" (approved by the Primorski Krai Duma on 28 July 1999).
The Decree establishes the following profit tax rates payable to the Budget of Primorski Krai:
1. In the amount of 27% for enterprises on the profit derived from intermediary operations, insurance business, brokerage firms, banks and other credit organizations; 2. 19% – in other cases (including foreign legal entities). This Decree affects legal relationships arising after 1 April 1999.
- The Governor of the Primorski Krai issued Resolution No. 317, "On Changes to the Resolution of the Governor of Primorski Krai of 7 May 1996 "On the Fees for [Issuance of ] Annual Licenses to Individuals and Legal Entities" on 26 July 1999.
This Resolution establishes the annual cost of the licenses issued to individuals and legal entities. Certain categories of individuals are eligible for a 30% reduction of the license cost established for a particular activity. Said benefit does not apply to sale of fuel and lubricants, solid fuel, timber, fish, and sea products. The Resolution also establishes the time and the amounts of the quarterly payments and the fines for losing the license.
The Resolution is in effect since 1 August 1999.
- The Vladivostok City Administration on 28 May 1999 adopted Resolution No. 985 "On the Plan for Undertakings to Increase the Revenue Portion of the Budget, to Decrease the Expenditure Portion of the Budget, and for Effective Use of Budgetary Funds for 1999".
In connection with Vladivostok's budget deficit, caused by non-payments to the budget and by the complicated situation in financing the city's survival-related items and items in the social sphere, a plan for undertakings to increase the revenue portion of the budget, to decrease the expenditure portion of the budget, and for the effective use of budgetary funds in 1999 was confirmed.
In particular, the city plans to conduct a restructuring of debts, including penalties and fines imposed on municipal institutions, enterprises and organisations; to conduct audits of enterprises' tax payments; to develop a new method for calculating land lease payments based on types of land use and on categories of lessors, in order to reduce the arrears in land lease payments; to impose a moratorium on offering benefits regarding taxes and other payments to the city budget; and other undertakings intended to make effective use of budgetary funds.
Transport
- On 17 August 1999 the Governor of Primorski Krai issued Resolution No. 359 "On Regulation of Appraisal Activity in the Transportation [Sphere] on the Territory of Primorski Krai."
This Resolution approves the "Regulation on the Authorized Regional Agency on Control over and Regulation of Appraisal Activity in Transportation [Sphere] in the Territory of Primorski Krai." State organization "Primgosavtonadzor" was designated as such authorized entity.
