opening address: the new ip economy

The old industrial era has been replaced by a new knowledge economy, based on ideas and innovation rather than land and natural resources. Companies that do not claim their stake in the future will wake up and discover that their competitors own the patents they need to operate their business. Market leaders in many industries are now using their patents as competitive weapons to capture and defend markets, outflank rivals and increase market value and revenue. Companies that ignore the growing power and value of patents do so at their peril. Welcome to the new competitive battlefield. Topics for discussion include:

  • The new competitive weapon--patents
  • How patents drive market value
  • The new patent focus sweeping across all industries: real stories about real companies

speaker:
robert cote, orrick, herrington & sutcliffe llp

panel session 1 - the patent life cycle

Patent activity is mushrooming across virtually every sector of the new knowledge-based economy as companies seek to gain a proprietary market advantage, an exclusive hold over a new technology or an opportunity to tap new revenues. Obtaining patents is no longer a matter of simply protecting your technology or products from being copied. It is about critical business strategy. This session will explain how to best position your company in this new economy. Topics for discussion include:

  • The art of patent asset management--creating a culture of innovation
  • Determining what, when and where to patent
  • Managing costs, resources and timelines
  • Integrating business strategy and patent strategy
  • Why a Chief Intellectual Property Officer is needed

moderator:
neil henderson
, bereskin & parr

panelists:
diana cianciusi, senior counsel, corporate operation and assistant secretary, cognos incorporated
robert isackson, orrick, herrington & sutcliffe llp
lesley rapaport, director of intellectual property, chondrogene inc.

panel session 2 - monetizing ip: analyzing and leveraging patent portfolios

Most companies are still unaware of the enormous economic and competitive values lying untapped within their patent portfolios. This session will explain how to identify and utilize these "Rembrandts in the Attic" to tremendous effect--Ampex, for example, a supplier of data storage systems, saw its stock price jump from $0.68/share in December 2003 to almost $55.00/share in January 2005 after the company uncovered among its patent portfolio (long overlooked) digital imaging patents that it now licenses to the consumer electronics industry. Topics for discussion include:

  • Analyzing and determining the best monetization strategy for your company's goals
  • Exploring the options--licensing, spin-out or cost reduction

moderator:
matt zischka, smart & biggar

panelists:
don merino, general manager, intellectual property, intellectual ventures
james skippen, senior vp, patent licensing and general counsel, mosaid technologies inc.
matthew vella, senior patent counsel, ati technologies

12:15 p.m. - 1:25 p.m.

luncheon and joint presentation - accessing venture capital

speakers:
john bautista, orrick, herrington & sutcliffe llp
tom sweeney, managing director and general partner, garage technology ventures canada lp

panel session 3 - patent trolls: real or myth

The Blackberry battle between Research In Motion and NTP has focused attention like never before on "patent trolls" and triggered cries for drastic reforms to U.S. patent law. The problem with targeting and blaming "trolls" is that perpetrators are surprisingly hard to identify and legislative reforms aimed at trolls may well end up doing more harm than good. This session will get you beyond the hype and to the heart of the issues. Topics for discussion include:

  • Identifying "patent trolls"
  • Both sides of the debate
  • Impact of the U.S. Supreme Court's May 2006 decision in MercExchange v. eBay
  • Patent law reforms targeting trolls

moderator:
john orange, blake, cassels & graydon llp

panelists:
steven adam, vice president, patent intelligence, chipworks
granT lynds, gowling lafleur henderson, llp (former patent counsel, nortel networks)
rodger sadler, orrick, herrington & sutcliffe llp
james skippen, senior vp, patent licensing and general counsel, mosaid technologies inc.
matthew vella, senior patent counsel, ati technologies

panel session 4 - managing intellectual property disputes and litigation

Knowledge is power. This session will demystify the U.S. patent litigation process and explore patent assertion and defense strategies critical for success in the new IP economy. Topics for discussion include:

  • Proactive patent litigation strategies for patent holders and alleged infringers
  • Lessons learned from fending off patent predators
  • Pre-filing considerations, including factors and statistics for choosing the right battlefield ("forum shopping"), if litigation is necessary
  • The litigation discovery process in the United States
  • The jury trial of a patent dispute

moderator:
christopher van barr
, gowling lafleur henderson, llp

panelists:
robert cote, orrick, herrington & sutcliffe llp
