Cynthia A. Lock, Of Counsel in Orrick's Orange County office, is a member of the Intellectual Property Group.  She focuses her practice on matters for clients at all stages of litigation in the areas of patent infringement, trademark and trade dress infringement, right of publicity, false advertising, dilution, antitrust and unfair competition.

Ms. Lock has represented and counseled clients on intellectual property and business litigation matters.  Her experience also includes representation of clients on appeal, representation of clients at settlement conferences and mediations, extensive written and oral motion practices, written discovery, and defending and taking depositions.

The following are representative of Ms. Lock's engagements:

  • Defended a Belgian medical device manufacturer in a case involving allegations of infringement of five patents, violation of the Lanham Act and unfair competition.  Published decision on appeal:  Optivus Technology, Inc. v. Ion Beam Applications, S.A., 469 F.3d 978 (Fed. Cir. 2006).
  • Second chair at a jury trial defending a kitchen product company against allegations of trade dress infringement and false advertising under the Lanham Act and unfair competition.  Directed verdict affirmed at Magic Kitchen LLC v. Good Things Int'l, Ltd., 153 Cal. App. 4th 1144 (2007).
  • Second chair at a jury trial defending a German company against a breach of contract claim arising out of the use of commercial advertisement.  Complete defense verdict.
  • Represented a medical device company in a series of patent infringement cases involving cardiac stents.
  • Represented an automobile manufacturer in a patent infringement case brought by patent troll.
  • Defended a lingerie company against claims of patent infringement and trade dress infringement.
