Andrew Dale

Mr. Andrew Dale, a partner in Orrick's Hong Kong office, is a member of the Litigation Group. He concentrates his practice on complex contentious matters including commercial litigation, corporate investigations, international arbitration, intellectual property and product liability.  Recent experience includes the following matters.

Commercial Litigation

• Defending a Hong Kong-listed PRC manufacturer in a high profile dispute relating to the alleged use of confidential information.
• Advised a major Hong Kong technology conglomerate on an application for a letter of request for the disclosure of documents by a bank to assist in pursuing a US$700 million breach of contract/fraud claim in the California courts.
• Represented a Taiwanese client in the Court of Final Appeal applying to challenge jurisdiction of the Hong Kong court in several cases involving major claims relating to breach of fiduciary duty and constructive trust.
• Opposed an application to give effect to a letter of request issued by a U.S. company in a Californian Court against the CEO of a Hong Kong toy company.

Corporate Investigations

• Advising a U.S.-listed company on a major investigation relating to its Asian operations.
• Representing a Japanese client in a multi-jurisdiction asset tracing exercise.
• Advised a global client on an internal investigation involving the misappropriation of funds and confidential information.

International Arbitration

• Representing a major Taiwanese manufacturer in a HKIAC arbitration arising from the sale of part of its business.
• Acting for an investment fund relating to a real estate investment involving HKIAC arbitration.
• Represented the vendor of a major cosmetics business in China in a multi-million U.S. dollar ICC arbitration in Singapore.
• Acted for a technology company in a multi-million U.S. dollar HKIAC arbitration claim in Hong Kong.

Intellectual Property

• Represented a major Japanese electronics manufacturer taking anti-counterfeiting action in Hong Kong, Mainland China, Taiwan, Israel, Japan and Sweden.  
• Advised a technology company dealing with software copyright infringement, including liaising with the regulatory authorities.

Product Liability

• Significant experience acting on product liability matters and product recalls including counseling clients on due diligence and proactive protection measures.
