Ms. Cindy Gong, an associate in Orrick's Shanghai office, is a member of both the Intellectual Property Group and the Corporate Group. She focuses on intellectual property and general corporate matters.
Ms. Gong is experienced in intellectual property and has been involved in trademark prosecution and litigation, copyright issues, drafting and reviewing non-disclosure and non-compete agreements, licensing, anti-counterfeiting, trade secret litigation, domain name disputes and patent litigation, as well as Section 337 U.S. International Trade Commission (ITC) litigation.
Ms. Gong has assisted numerous foreign invested enterprises with general corporate matters. She has extensive experience in the establishment of foreign invested enterprises, including wholly foreign owned enterprises and joint ventures. Ms. Gong has been involved in large mergers and acquisition deals, including assisting with the due diligence, preparing paperwork and providing assistance throughout the entire merger and/or acquisition process.
Ms. Gong has extensive experience in PRC pharmaceutical law, including registration of medical device and pharmaceuticals with China State Food and Drug Administration (SFDA), as well as other regulatory work. She has also worked on antitrust filings as well as Foreign Corrupt Practices Act (FCPA) and anti-corruption related matters.
Ms. Gong's recent transactions have included advising:
- An international chemical company, on its potential trademark litigation against a Chinese domestic company.
- Numerous foreign companies in connection with trademark and technology licensing, IP due diligence and portfolio counseling.
- A prominent U.S. home improvement retailer on trademark prosecution in China and Hong Kong.
- Numrous multinationals on establishment of Foreign Invested Enterprises in China.
- An international pharmaceutical company, on regulatory compliance and proceedings in several Asian jurisdictions, including mainland China, Hong Kong, Taiwan, South Korea, Thailand and Indonesia; providing assistance in medical device registration with the China State Food and Drug Administration (SFDA).
- Several multinationals on providing assistance in registration of Chinese domain names and internet keywords.
- A number of foreign companies on FCPA and Chinese anti-bribery issues.
- A leading international manufacturers in connection with their antitrust filing with the China Ministry of Commerce (MOFCOM) and the State Administration of Industry and Commerce (SAIC).
Before joining Orrick, Ms. Gong previously worked for two large international law firms in Intellectual Property, Foreign Direct Investment and general corporate matters.
