Dr. Xiang Wang is the lead partner for Orrick's China-focused intellectual property practice; he spends his time between three offices: Shanghai, Silicon Valley and Beijing, where he is the administrative partner-in-charge. Dr. Wang assists local and foreign-based multinational companies with all aspects of their intellectual property rights in China, Hong Kong and the United States. Dr. Wang has extensive experience representing both foreign and Chinese companies protecting their R&D and IP in global markets, including IP-related litigation in the United States and China. Dr. Wang has developed the region's premier IP practice based on his reputation as one of the only IP lawyers who has a doctorate in electrical and computer engineering, a Chinese Certificate of Laws and admission to practice law in New York, Indiana and before the U.S. Patent and Trademark Office. Dr. Wang also has received four U.S. medical-technology patents in his name. Dr. Wang's IP related services include the following. - Prosecution, enforcement and technology transfer/licensing arrangements for substantial patent and trademark portfolios for companies doing business in China.
- Office actions, oppositions, patent invalidation proceedings, anti-counterfeiting, anti-piracy efforts, and patent and trademark enforcement litigation, both in China and the United States.
- Cross-boarder litigation on trade secret, export control and industrial espionage.
- Section 337 U.S. International Trade Commission (ITC) litigation.
- Representing medical device and pharmaceutical companies in regulatory compliance and proceedings in China and the United States, including assistance with submissions to the China State Food & Drug Administration (SFDA) and the U.S. Food & Drug Administration (FDA), drug and device import registrations and licenses, GMP and GSP, insurance reimbursement, and other government and regulatory affairs, as well as CRO and OEM contracts.
- Technology transfer and OEM contracts, joint ventures and strategic partnerships for R&D and manufacturing.
- IP due diligence and portfolio counseling.
- Assisting multinational corporations on Foreign Corrupt Practices Act (FCPA) compliance issues.
- Employment contracts, policies and best practices, labor disputes and preventive measures thereof.
- Representing media and entertainment multinational corporations in their legal and business issues including film, TV programs, electronic games, Internet activities, theme parks, publication and related products in China.
Dr. Wang is highly regarded for his practical legal advice that results from more than 10 years of experience at medical and electronic device businesses before becoming a lawyer. His practical industry experience includes the following. - Dr. Wang has served as the managing director of Asian services for a U.S. medical technology consulting firm, a senior consultant and member of the Scientific Advisory Board of a U.S. medical device manufacturer, the executive director of R&D for a U.S. medical device manufacturer, the director of medical research for the department of surgery of a major U.S. hospital, a software engineer and system analyst for two major U.S. medical device manufacturers and a biomedical engineer for the Sino-Japanese Friendship Hospital in Beijing.
- In these positions, Dr. Wang has developed, directed and manufactured medical devices; selected, investigated and negotiated corporate partners; organized, advised and edited PMA and FDA 510(k) applications; supervised and complied with FDA, UL 544, CSA and other regulations; and designed and accomplished clinical research.
Dr. Wang is well recognized for his commitment to help guide the development and advancement of IP laws, regulations and cross-border relationships that affect companies doing business in China. Dr. Wang served as vice chair of the Intellectual Property Committee of the American Chamber of Commerce in Shanghai and as counsel for the R&D-based Pharmaceutical Association in China. Dr. Wang also serves as an adjunct professor of electrical and biomedical engineering at Drexel University in Philadelphia, Pennsylvania.
